It specifically analyses the way in which IIL protections impact on the parallel protection of economic, social and cultural rights (ESC rights) in the host state, especially the right to water. Arguing that current responses have been unsatisfactory, it considers the emergence of the 'Protect, Respect and Remedy' framework and the Guiding Principles for Business and Human Rights (jointly the Framework) as a possible analytical instrument. In so doing, it proposes a different approach to the way in which the Framework is generally interpreted, and then investigates the possible applicability of this 'recalibrated' Framework to the study of the IHRL-IIL interplay in a host country in a protracted armed conflict: Afghanistan. Through the emblematic example of Afghanistan, the book presents a practical dimension to its legal analysis. It uniquely portrays the elusive intersection between these two bodies of international law within a host country where the armed conflict continues to rage and a full economic restructuring is taking place away from the public eye, not least through the deployment of IIL and the inaction - or merely partial consideration - of IHRL. The book will be of interest to academics, policy-makers, and practitioners of international organisations involved in IHRL, IIL and/or deployed in contexts of armed conflict.

Binding Type: Paperback
Author: Davitti, Daria
Published: 12/17/2020
Publisher: Hart Publishing
ISBN: 9781509946143
Pages: 288
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_f76d6308-d393-4906-beac-f69e6b157140.jpg?v=1602781552
mississippi-after-a-life-in-equal-justice-law-9781940722047
Mississippi & After: A Life in Equal Justice Law
An inspirational book for those who want to use their legal interests, skills and talents to bring about greater social justice. This memoir frankly recounts that exhilarating, gritty, sometimes harrowing experience and how it led Gil into a lifelong dedication to equal justice, environmental and other public interest law in his native Pittsburgh, Boston and Phoenix. The book is a primer on the legal tools of social justice and how they are applied. Their greatest use lay in reassuring the white residents that they shared the same goal, while sending a warning to would-be minority entrants: keep out. As a matter of constitutional practice, human dignity has emerged in jurisdictions around the world as the organizing idea of a groundbreaking paradigm. By reconfiguring constitutional norms, institutional structures and legal doctrines, this paradigm transforms human dignity from a mere moral claim into a legal norm that persons have standing to vindicate. As a matter of constitutional theory, however, human dignity remains an enigmatic idea. Some explicate its meaning in abstraction from constitutional practice, while others confine themselves to less exalted ideas. The result is a chasm that separates constitutional practice from a theory capable of justifying its innovations and guiding its operation. By expounding the connection between human dignity and the constitutional practices that justify themselves in its light, Jacob Weinrib brings the theory and practice of constitutional law back together.

Binding Type: Paperback
Author: Weinrib, Jacob
Published: 12/20/2018
Publisher: Cambridge University Press
ISBN: 9781107446243
Pages: 315
Weight: 0.93lbs
Size: 9.00h x 6.00w x 0.66d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_13a9b0fe-0b76-4cd8-b459-29c4a98efd90.jpg?v=1605736566
torture-inhumanity-and-degradation-under-article-3-of-the-echr-absolute-rights-and-absolute-wrongs-9781509902996
Torture, Inhumanity and Degradation Under Article 3 of the Echr: Absolute Rights and Absolute Wrongs

This book theorises and concretises the idea of 'absolute rights' in human rights law with a focus on Article 3 of the European Convention on Human Rights (ECHR). It unpacks how we might understand what an 'absolute right' in human rights law is and draws out how such a right's delimitation may remain faithful to its absolute character. From these starting points, it considers how, as a matter of principle, the right not to be subjected to torture or inhuman or degrading treatment or punishment enshrined in Article 3 ECHR is, and ought, to be substantively delimited by the European Court of Human Rights (ECtHR). Focusing on the wrongs at issue, this analysis touches both on the core of the right and on what some might consider to lie at the right's 'fringes': from the aggravated wrong of torture to the severity assessment delineating inhumanity and degradation; the justified use of force and its implications for absoluteness; the delimitation of positive obligations to protect from ill-treatment; and the duty not to expel persons to places where they face a real risk of torture, inhumanity or degradation.

Few legal standards carry the simultaneous significance and contestation surrounding this right. When national law refuses to recognize a claimed right, litigants regularly reassert that right before the Strasbourg Court. Utilizing narratives of black female lawyers, this book offers a blend of accessible theory to benefit any reader willing to learn about the underlying challenges that lead to their high attrition rates. Drawing from narratives of black female lawyers, their experiences center around gendered racism and are embedded within institutional practices at the hands of predominantly white men. In particular, the book covers topics such as appearance, white narratives of affirmative action, differences and similarities with white women and black men, exclusion from social and professional networking opportunities and lack of mentors, sponsors and substantive training. This book highlights the often-hidden mechanisms elite law firms utilize to perpetuate and maintain a dominant white male system. Weaving the narratives with a critical race analysis and accessible writing, the reader is exposed to this exclusive elite environment, demonstrating the rawness and reality of black women's experiences in white spaces. Finally, we get to hear the voices of black female lawyers as they tell their stories and perspectives on working in a highly competitive, racialized and gendered environment, and the impact it has on their advancement and beyond.

Binding Type: Hardcover
Author: Melaku, Tsedale M.
Published: 04/18/2019
Publisher: Rowman & Littlefield Publishers
ISBN: 9781538107928
Pages: 200
Weight: 0.90lbs
Size: 9.20h x 6.30w x 0.80d
Tsedale M. It represents a response by people with disabilities to being treated with scorn and abuse or as objects of pity, and to having the most fundamental decisions relating to their lives--where they would live; if and how they would be educated; if they would be allowed to marry or have families; indeed, if they would be permitted to live at all--made by those who were, in the parlance of the movement, "temporarily able-bodied." In What We Have Done: An Oral History of the Disability Rights Movement, Fred Pelka takes that slogan at face value. He presents the voices of disability rights activists who, in the period from 1950 to 1990, transformed how society views people with disabilities, and recounts how the various streams of the movement came together to push through the Americans with Disabilities Act of 1990, the most sweeping civil rights legislation since passage of the Civil Rights Act of 1964. Beginning with the stories of those who grew up with disabilities in the 1940s and '50s, the book traces how disability came to be seen as a political issue, and how people with disabilities--often isolated, institutionalized, and marginalized--forged a movement analogous to the civil rights, women's rights, and gay rights movements, and fought for full and equal participation in American society.

Binding Type: Paperback
Author: Pelka, Fred
Published: 02/14/2012
Publisher: University of Massachusetts Press
ISBN: 9781558499195
Pages: 622
Weight: 1.96lbs
Size: 8.99h x 6.09w x 1.54d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_4886280d-b107-4e9d-86a9-4c305f9523a5.jpg?v=1605737005
the-basics-of-freedom-9781640272293
The Basics of Freedom

The Basics of Freedom presents simple explanations of the fundamental principles that provide the foundational structure for the United States government. This book describes what linguistic human rights are, who has and who does not have them and why, and suggests which linguistic rights should be regarded as basic human rights. Linguistic Human Rights introduces a new area, combining sociolinguistics, educational, and minority concerns with human rights. Discrimination against language minorities is widespread, despite national and international law prohibiting this. The book analyzes language rights in many countries worldwide, including North and Latin America, several European states, the former USSR, India, Kurdistan, Australia and New Zealand.

Binding Type: Hardcover
Author: Skutnabb-Kangas, Tove
Published: 06/20/1995
Publisher: Walter de Gruyter
ISBN: 9783110148787
Pages: 484
Weight: 1.59lbs
Size: 9.04h x 6.12w x 1.05d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_a7dcde41-3d47-43cc-9635-cc385048f9e0.jpg?v=1605738781
value-of-information-intellectual-property-privacy-and-big-data-9783631750131
Value of Information: Intellectual Property, Privacy and Big Data

The right information, at the right time, for the right user has become the most valuable currency of our times. This book discussses historical aspects of rights protection, including Diceyan concepts of parliamentary supremacy and the rule of law, before considering historical support for limits to the power of Parliament. The book discusses theoretical justifications for the power of judges to declare laws inconsistent with human rights to be invalid, including social contract theory and modern versions of democracy. In this context, comtemporary human rights issues are then considered. These include the recent laws allowing groups to be outlawed based on a politician's declaration, laws that limit the right of an accused person to jury trial, both at the national and regional level, laws that restrict voting rights, laws that restrict the ability of a person to work in different regions within Australia, and laws that allow a person to be detained based on an assessment of their future risk to society. Dr. Dexter Reno Johnson, Professor of Law, Commonwealth Scholar and Medicolegal consultant questions the reluctance of the law to accept the new young person. Why is the court reluctant to confer competence on young persons in critical medical decision making? Today's young person must be considered more advanced than those of yesteryear. Can Judges design appropriate assessment in law of the competence of a Young person to make a tough medical decision? In this work, Dr. Johnson argues that overly paternalistic judges are applying anachronistic law, out of step with current concepts of today's young person. In fact, many of the obligations to respect, protect and fulfill human rights go to states. But it has become evident that states are not the only subjects of these obligations. Transnational corporations, among the non-state actors have been involved in activities that very much impacted human rights. Nowadays, government is no more sole employer; corporations provide for ample job opportunities and administer millions of workers. Corporations have become more and more involved in activities which once were left exclusively for governments. As such, it is now beyond debate that activities of corporations affect human rights. But whether corporations bear legal obligations with respect to human rights is an issue not yet resolved. The book enlightens readers on such issue thereby making a critical examination of the developing international trend. The Summit agreed to take practical measures in order to tackle impunity for the use of sexual violence as a weapon of war and to begin changing global attitudes towards these crimes. This makes obvious that, although some progress has been made in recognizing rape and other acts of sexual violence as war crimes, the international and national response thereon remains to this day unclear and inadequate. The case of Bosnia offers a unique example to understand the systematic and organized form that sexual violence can take during war, its consequences and the steps required to prevent future crimes of such nature, as this was the first time in history that sexual violence was officially recognized as a war crime and a crime against humanity. This qualitative study explores if and how sexual violence was used as a weapon of war in Bosnia, its aim and the socio-cultural circumstances under which it took place. Drawing upon findings from six semi-structured interviews with a group of individuals who have expertise on this topic and from official documents of the ICTY, the conclusion of this research is that sexual violence was undoubtedly used as a wartime weapon by the Serbian and Bosnian Serb forces in order to achieve ethnic cleansing of-mainly- the Bosnian Muslims and the Croats. The findings also show that, even if this campaign of sexual violence was not organized by the highest levels of political and military leadership, it was definitely tolerated by them.

Binding Type: Paperback
Author: Derziotis, Ioannis
Published: 11/12/2018
Publisher: Grin Verlag
ISBN: 9783668830943
Pages: 78
Weight: 0.25lbs
Size: 8.27h x 5.83w x 0.19d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_8b1f319e-33a0-4a9f-b458-c22a24d8fe1f.jpg?v=1605738855
the-subjection-of-women-original-edition-of-1911-9783959401746
The Subjection of Women: Original Edition of 1911
Complete digitally restored reprint (facsimile) of the original edition of 1911 (second edition) with excellent resolution and outstanding readability. Institutional reform, and in particular that of a thoroughgoing reform of the Italian Constitution, has long been a topic of discussion among the Italian public and scholars of law and politics, including the institutions themselves. There is a complex debate on the relationship between sovereignty and constituent power or to give account of the very widespread, and in some way even pervasive, belief held by many exponents of political and legal culture in Italy and beyond, that constitutionalism is above all a matter of fundamental rights. These beliefs substantially, as in the classic forms of constitutionalism, see in a constitution 'the idea of a law that does not depend on even the strongest political power' and precisely for this reason envisage the substantial autonomy of contingent political balancing forces. The current thinking on this question on the one hand evokes the (to some extent) reasonable 'armouring', of the fundamental core of the Constitution as a charter of the rights of individuals and groups while also deeming it necessary to resist the 'lightness' of the political class in solving the problems of reorganising the political system with the all-too-easy evocation of various kinds of constituent 'powers' and 'stages'. This book analyses all these issues and more within the context of Italy and the whole of Europe.

Binding Type: Paperback
Author: D'Alessandro, Chiara Antonia
Published: 03/14/2019
Publisher: Eurytion Press, S.L.
ISBN: 9788494922282
Pages: 98
Weight: 0.31lbs
Size: 9.02h x 5.98w x 0.20d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_a6405021-4b86-4b37-a8cb-011503225eaf.jpg?v=1605739009
from-privacy-toward-a-new-intellectual-prop-right-in-persona-9789041103550
From Privacy Toward a New Intellectual Prop Right in Persona
This book is an important study of the controversial right' of persons to control the commercial use of their likeness, name, voice and other identifying indicia. In the first part, the author describes the right of publicity in the United States and the portrait right in the Netherlands, and discusses other relevant theories such as the right of privacy, copyright law, trademark law, false advertising law, misappropriation theories and neighbouring rights. In the second part, the author analyses whether the right of publicity tort can be developed into a new intellectual property right. In a challenging study, the author discusses the justifications and property nature of this intellectual property right and its conflict with the principles of free trade and free speech . The author concludes that it is possible to define a new assignable and descendible intellectual property right in which the principles of free trade and free speech are integrated: the Right of Persona . This book will be a valuable and practical source of case law and literature on the protection of celebrities and non-famous persons against the unpermitted use of their identity by advertisers, the press, the entertainment industry and other media.

Binding Type: Paperback
Author: Pinckaers, Julius C. This penetrating analysis of the thorny problems in this area of the law goes a long way toward clarifying the nature of the conflicts and disputes that arise and that are likely to continue to arise. The author first examines the international jurisdictional problems related to the Internet and new technologies. Starting from an economic analysis of the law of cyberspace, the author demonstrates that the problem of conflicting legal rules may be solved by adopting new laws, regulations and guidelines governing the Internet. The second part explores the ways in which the Internet and the introduction of new information technologies has dramatically affected the world of work and individual rights. The author analyses the origins, limits and boundaries of these rights, and makes a comparative analysis of the relevant constitutions and statutes in both common law and civil law. Finally, an examination of the legal systems of the USA, the UK, France, Germany, Italy, and Japan, and of their responses to the new Internet-related issues, enable the author to propose effective ways to achieve a better balance between the employee's right to privacy and the responsibilities of the employer in the new electronic environment.

Binding Type: Paperback
Author: Blanpain, Roger
Published: 07/01/2002
Publisher: Kluwer Law International
ISBN: 9789041118240
Pages: 186
Weight: 0.72lbs
Size: 9.60h x 6.36w x 0.49d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_04c13da3-cbea-42b6-96a6-1f0c852f2d37.jpg?v=1605739029
human-rights-and-justice-international-documents-9789380177328
Human Rights and Justice: International Documents
A series of international human rights treaties and other instruments adopted since 1945 have conferred legal status on inherent human rights and developed the body of international human rights law. However, human rights violations are a fact of life in all countries, though to differing degrees. These violations involve all kinds of rights: civil, cultural, social, economic, and political. Access to justice is a basic human right, as well as an indispensable means of combating poverty and preventing and resolving conflict. Access to justice means much more than improving an individual s access to courts. It is about ensuring that legal and judicial outcomes are just and equitable and that systems work in practice for the poor and disadvantaged, who tend to get victimized by corrupt or indifferent officials, without having a reasonable chance to seek legal remedies for their grievances. This book contains 62 international documents dealing with human rights and the administration of justice under one cover. The chapters have been so organized as to provide easy reference based on the status of the victim. This handy reference is a must for members of the armed forces and police, legal fraternity, NGOs, human rights activists, academicians and researchers."

Binding Type: Hardcover
Author: Jha
Published: 04/16/2014
Publisher: Vij Books India
ISBN: 9789380177328
Pages: 604
Weight: 2.77lbs
Size: 10.00h x 7.01w x 1.31d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_f6dc372c-63d1-4880-b926-7537700bd739.jpg?v=1605739068
yearbook-of-the-european-convention-on-human-rights-annuaire-de-la-convention-europeenne-des-droits-de-lhomme-the-european-commission-and-european-9789401512022
Yearbook of the European Convention on Human Rights / Annuaire de la Convention Europeenne Des Droits de l'Homme: The European Commission and European
PREMIERE PARTIE TEXTES FONDAMENTAUX ET INFORMATIONS DE CARACTERE GENERAL CHAPITRE I. This book aims to provide a clear understanding of what this type of risk-based approach involves. The analytical approach adopted by this book ensures that readers will achieve the following: i. Identify modern slavery and human rights risks where they have operations or supply chain(s). ii. Assess the potential modern slavery and human rights risks of their supply chains. iii. Determine how modern slavery and human rights issues can best be remediated or mitigated through measures such as training and awareness, whistle-blowing mechanisms, and industry collaboration, or improved internal purchasing practices. iv. Measure the effectiveness of risk control measures. Internationally, this book would be the first comprehensive book on the assessment and mitigation of modern slavery and human rights risk(s) within the global supply chain infrastructure. This book would help commercial organisations and business enterprises with any problem regarding the application of the risk-based approach. Business enterprises that implement the risk-based approach, in line with the guidance given in this book, will be well-placed to avoid the consequences of inappropriate de-risking behaviour. Although there are quite a number of reference guides provided by the United Nations, the Organisation for Economic Co-operation and Development (OECD), the United Kingdom Home Office, and the Ethical Trading Initiative (ETI) to assist firms with the implementation of the risk-based approach, those publications focus mainly on the risk assessment principles. This book is particularly focused on both the principles and the practical aspect of its application. This book is a must read for every professional specializing in the field of risk management and supply chains. It is also a must read for every individual who intends to know more about risk mitigation measures for modern slavery and human rights issues.

Binding Type: Paperback
Author: Esoimeme, Ehi Eric
Published: 09/22/2019
Publisher: Dsc Publications Ltd.
ISBN: 9789782787910
Pages: 324
Weight: 0.96lbs
Size: 9.02h x 5.98w x 0.68d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_d13c40cf-c18d-4cbc-9ff9-7e44299cfae0.jpg?v=1605739315
the-limits-of-human-rights-9780198824763
The Limits of Human Rights
Questioning the idea that the growth of the international human rights regime is limitless, this book examines the functional, systemic, and ideological boundaries of human rights law from a multidisciplinary perspective.

Binding Type: Paperback
Author: Fassbender, Bardo
Published: 01/21/2020
Publisher: Oxford University Press, USA
ISBN: 9780198824763
Pages: 416
Weight: 1.40lbs
Size: 9.10h x 6.10w x 1.10d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_9de7df06-b4fd-4115-b394-586be2b2ebf4.jpg?v=1605739378
life-after-privacy-reclaiming-democracy-in-a-surveillance-society-9781108491365
Life After Privacy: Reclaiming Democracy in a Surveillance Society
Privacy is gravely endangered in the digital age, and we, the digital citizens, are its principal threat, willingly surrendering it to avail ourselves of new technology, and granting the government and corporations immense power over us. In this highly original work, Firmin DeBrabander begins with this premise and asks how we can ensure and protect our freedom in the absence of privacy. Can--and should--we rally anew to support this institution? Is privacy so important to political liberty after all? DeBrabander makes the case that privacy is a poor foundation for democracy, that it is a relatively new value that has been rarely enjoyed throughout history--but constantly persecuted--and politically and philosophically suspect. The vitality of the public realm, he argues, is far more significant to the health of our democracy, but is equally endangered--and often overlooked--in the digital age.

Binding Type: Hardcover
Author: Debrabander, Firmin
Published: 09/08/2020
Publisher: Cambridge University Press
ISBN: 9781108491365
Pages: 180
Weight: 0.80lbs
Size: 9.09h x 6.30w x 0.62d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_5813fa77-a4bf-48cf-b976-de5c52e27100.jpg?v=1605739570
practical-equality-forging-justice-in-a-divided-nation-9780393358551
Practical Equality: Forging Justice in a Divided Nation

Robert L. It challenges the idea that many constitutional orders are facing permanent states of emergency due to the 'objective nature' of threats facing modern states today, arguing instead that the nature of a threat depends upon the subjective assessment of the decision-maker. In light of this, it further argues that robust judicial scrutiny and review of these decisions is required to ensure that the temporariness of the emergency is a legal question and that the validity of constitutional norms is not undermined by their perpetual suspension. It does this by way of a narrower conception of the rule of law than standard accounts in favour of judicial review of emergency powers in the literature, which tend to be based on the normative value of human rights. In so doing it seeks to refute the fundamental constitutional challenge posed by Carl Schmitt: that all state power cannot be constrained by law.

Binding Type: Paperback
Author: Greene, Alan
Published: 09/03/2020
Publisher: Hart Publishing
ISBN: 9781509940257
Pages: 256
Weight: 0.76lbs
Size: 9.21h x 6.14w x 0.51d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_a888d14f-70dd-4a91-80b2-fcf1d170fcba.jpg?v=1605740481
coercive-human-rights-positive-duties-to-mobilise-the-criminal-law-under-the-echr-9781509937875
Coercive Human Rights: Positive Duties to Mobilise the Criminal Law Under the Echr
Traditionally, human rights have protected those facing the sharp edge of the criminal justice system. But over time human rights law has become increasingly infused with duties to mobilise criminal law towards protection and redress for violation of rights. These developments give rise to a whole host of questions concerning the precise parameters of coercive human rights, the rationale(s) that underpin them, and their effects and implications for victims, perpetrators, domestic legal systems, and for the theory and practice of human rights and criminal justice. This collection addresses these questions with a focus on the rich jurisprudence of the European Court of Human Rights (ECtHR).

The collection explores four interlocking themes surrounding the issue of coercive human rights:

First, the key threads in the doctrine of the ECtHR on duties to mobilise the criminal law as a means of delivering human rights protection.

Secondly, the factors that contribute to a readiness to demand coercive measures, including discrimination and vulnerability, and other key justificatory reasoning shaping the development of coercive human rights.

Thirdly, the most pressing challenges for the ECtHR's coercive duties doctrine, including:

- how it relates to theories and rationales of criminalisation and criminal punishment;
- its implications for the fundamental tenets of human rights law itself;
- its relationship to transitional justice objectives; and
- how (far) it coheres with the imperative of effective protection for persons in precarious or vulnerable situations.

Fourthly, the (prospective) evolution of the coercive human rights doctrine and its application within national jurisdictions.

Binding Type: Hardcover
Author: Lavrysen, Laurens
Published: 11/12/2020
Publisher: Hart Publishing
ISBN: 9781509937875
Pages: 328
Weight: 1.38lbs
Size: 9.21h x 6.14w x 0.75d
//cdn.shopify.com/s/files/1/0021/1697/6715/products/img_2a03d83d-8d54-4489-903d-e059663d34d7.jpg?v=1605740676
hate-speech-and-human-rights-in-eastern-europe-legislating-for-divergent-values-9780367437848
Hate Speech and Human Rights in Eastern Europe: Legislating for Divergent Values

Hate Speech and Human Rights.
